General
These Terms of Sale are a legal agreement between you (“User” or “you”) and Ideal Industries, Inc. (“IDEAL,” “we,” or “our”) that governs the sale of products and orders placed via this e-commerce website at https://idealelectricalmerch.myshopify.com/ (the “IDEAL website.”) IDEAL may amend these Terms of Sale from time to time. By making a purchase and/or accepting delivery of the products, you agree to be bound by these Terms of Sale. The Terms of Sale are subject to change without prior written notice at any time. You are encouraged to review the Terms of Sale each time you make a purchase. These Terms of Sale do not apply to export transactions or IDEAL Distributors, to which separate terms and conditions of sale apply.
Product Information
We attempt to ensure that the content on this website is accurate, complete, and current. However, we cannot guarantee that our website information is free from errors, inaccuracies or omissions relating to price, product description, availability or otherwise. We reserve the right to correct such errors or inaccuracies without notice. All product descriptions and information presented on the IDEAL website are made available solely for general information purposes. Any reliance you place on the website for product information is at your own risk. We disclaim any liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the e-commerce website, or by anyone who may be informed of any of its contents. Product colors may be affected by settings on your computer, or other devices from which you obtain access to the website.
Prices
All prices are in U.S. dollars for US residents and Canadian dollars for Canadian residents. The prices shall be the prices in effect at the time you place the order. Prices are subject to change without prior notice. Prices shown do not include taxes, shipping, special handling fees, or duties. Applicable taxes and any other fees (e.g. shipping) will be added to the purchase price upon checkout. Ideal does not offer price protection or refunds in the event of price decreases or promotions not in effect at the time of your order.
Orders
The receipt of an email order confirmation does not constitute our acceptance of the order. We reserve the right to decline to trade with any company or person and we have the right to refuse or cancel any order placed, whether or not payment has been received, by giving you notice of non-acceptance within a reasonable time after receipt of the order. If we reject or cancel an order for which payment has been made, we will issue a credit to your credit card account or refund the amount paid you as soon as reasonably practicable.
Orders for destinations outside of United States or Canada will not be processed.
Product Availability
Product availability may vary from time to time. We may provide substitute products where the product has been superseded by a newer version. To the extent that orders cannot be completely fulfilled, the unfulfilled balance will (at the IDEAL’s option) either be put on back order to be fulfilled when the products become available or be cancelled and refunded to you.
Freight Terms
Subject to any cancellation, substitution, or non-fulfilment of orders, your products will be delivered as specified in your order. IDEAL will use third party delivery agents to deliver products. Delivery options with pricing are set out on the IDEAL website on the date of order.
Delivery prices apply per order, irrespective of the number of products ordered. Delivery will be made to the address provided to IDEAL at the time of order.
IDEAL will not be liable for delays in delivery or other services caused by acts of God, acts or threats of terrorism, computer or electronic disruptions, failure of suppliers to deliver on time, or other circumstances beyond our control.
Return Policy
All returns require a proof of purchase and return authorization from Ideal. For return authorization, please contact us at idealelectricalmerch@idealindustries.com.
Not all returns will be accepted. The return policy does not cover buyer’s remorse, but does cover:
· Damaged Items – You can return misprinted, damaged, or defective items for exchange or refund up to thirty (30) days from the date of delivery. This excludes damage caused by normal wear and tear, defects caused by abuse, misuse, neglect, alterations, unauthorized repair, accidents, improper storage, presence of foreign matter or caused by events beyond the control of IDEAL. Using products other than as recommended constitutes misuse.
· Lost in Transit – For packages lost in transit, all claims must be submitted no later than 30 days after the estimated delivery date.
· Errors – Claims deemed an error on our part are covered at our expense. Claims must be submitted up to thirty (30) days from the date of delivery.
· Wrong Address – If you provide an address that is considered insufficient by the courier, the shipment will be returned to our facility. Claims must be submitted within 30 days after the estimated delivery date.
· Sizing – If a wrong size is ordered by mistake, please contact idealelectricalmerch@idealindustries.com to start an exchange. Limit 1 sizing exchange per order. Claims must be submitted up to thirty (30) days from the date of delivery. You will have the choice of two options in sizing exchanges:
1. To exchange the item: You will be responsible for the cost of shipping the item back to IDEAL and shipping costs for the new order.
2. To keep/donate the item: You can choose to keep/donate the item and place a new order and will receive a one-time 30% off code to use against a new order in lieu of shipping back the old item.
All eligible return requests must have a valid proof of purchase to be credited for the purchase price. Refunds will be issued to the original form of payment or via a gift card if a refund to the original form of payment is not possible. To receive a full refund, you must return the Products with all its components.
Warranty Disclaimer and Limitation of Liability
Except as set forth herein and to the extent permitted by law, no warranty, express or implied, is made or authorized by IDEAL AND IDEAL EXPRESSLY DISCLAIMES IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Except where prohibited by law, IDEAL will not be liable for any direct, indirect, special, incidental or consequential loss or damage arising from ITS product(S), regardless of the legal theory asserted. IDEAL ALSO DISCLAIMS ANY LIABILITY FOR CLAIMS ARISING OUT OF PRODUCT MISUSE, PRODUCT MODIFICATIONS OR UNAUTHORIZED REPAIR.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This LIMITED WARRANTY gives you specific legal rights, which vary from state to state.
